📜 SALES TERMS & CONDITIONS
SANTO GAMES SpA
By placing an order with Santo Games, the customer acknowledges having read and accepted these Sales Terms & Conditions. These terms apply without prejudice to any consumer rights granted under applicable law.
1. 📦 DOMESTIC ORDERS
1.1. Shipping and Logistics
Orders are shipped through third-party carriers such as Blue Express, Starken, or other shipping providers available at the time of dispatch. Santo Games SpA may select or change the carrier depending on availability, coverage, and logistical conditions.
1.2. Free Shipping
Free shipping may be available for purchases that meet the minimum order amount specified on our website and is subject to geographical coverage and carrier conditions.
1.3. Order Processing
Orders placed after 2:00 PM may begin processing on the following business day. Preparation and dispatch times may vary during periods of high demand, product launches, pre-orders, logistical disruptions, or force majeure events.
1.4. Transportation
Once an order has been handed over to the carrier, the shipment becomes subject to the carrier's operational procedures and delivery times. In the event of any issue during transportation, Santo Games will assist the customer and coordinate with the carrier as appropriate.
2. 🎯 PRE-ORDERS
2.1. Nature of Pre-Orders
A pre-order is an advance purchase of a product whose release, availability, or physical arrival is scheduled for a future date.
2.2. Estimated Dates
Release, arrival, and shipping dates provided are estimates and may be modified due to circumstances involving the manufacturer, distributor, importer, carrier, customs authorities, or other factors beyond the control of Santo Games SpA.
2.3. Product Releases
Santo Games SpA does not guarantee delivery of any product before its official release date.
2.4. Allocations and Stock Reductions
For high-demand products, particularly TCG and collectible products, the quantities ultimately supplied by manufacturers or distributors may be lower than those originally ordered or allocated.
If a stock reduction prevents Santo Games from fulfilling a pre-order in full, Santo Games may offer, as applicable:
- Delivery of the units actually available and a refund for the remaining balance.
- The option to wait for a confirmed restock.
- Cancellation and refund of the units that cannot be supplied.
2.5. Orders Containing Products with Different Release Dates
When a single order includes products with different release or availability dates, the entire order may be shipped once all products are available, unless separate shipping has been arranged or purchased.
3. 🔄 CANCELLATIONS, RIGHT OF WITHDRAWAL & LEGAL WARRANTY
3.1. Cancellations
Cancellation requests will be evaluated according to the status of the order, the nature of the product, and applicable law.
Santo Games' commercial terms shall not restrict any rights legally granted to consumers.
3.2. Right of Withdrawal
For purchases made remotely or electronically, the right of withdrawal shall apply in accordance with the circumstances, conditions, time limits, and exceptions established under applicable Chilean law.
3.3. Legal Warranty
New products are covered by the applicable legal warranty in accordance with Chilean Law No. 19,496 and other applicable regulations.
Where legally applicable, consumers may exercise the remedies provided under current consumer protection legislation.
4. 💰 REFUNDS & PAYMENT RETURNS
4.1. Refund Method
Whenever a full or partial refund is applicable, Santo Games SpA will process the refund through the payment platform, payment processor, or payment method used to process the original transaction, whenever technically applicable.
For payments made by credit card, debit card, prepaid card, or other electronic payment methods processed through a payment platform, the refund will be processed through that same platform.
4.2. No Replacement by Bank Transfer
When a payment has been processed through a payment platform, Santo Games SpA is not required to replace that platform's refund procedure with a separate bank transfer to an account subsequently provided by the customer, without prejudice to any rights granted under applicable law.
If, exceptionally, the original payment method does not allow the refund to be processed, Santo Games may request additional information in order to determine an alternative refund method.
4.3. Refund Confirmation
Once Santo Games SpA has processed the refund through the corresponding platform, Santo Games may provide the customer with the available receipt, transaction number, or confirmation showing that the refund has been requested or processed.
4.4. Refund Processing and Posting Times
The processing of a refund by Santo Games and the subsequent posting or appearance of the funds on the customer's account, card, or statement are separate stages.
Once Santo Games has processed the refund, the time required for the funds to appear or be credited will depend on the payment platform used, the card issuer, the customer's bank, the payment method, and, where applicable, the country in which the payment method was issued.
These processing times are determined by the financial institutions involved and may vary.
4.5. Mercado Pago
For transactions processed through Mercado Pago, refunds will be handled through the Mercado Pago platform. Customers should refer to the official processing and posting times provided by Mercado Pago for their specific payment method.
4.6. International Purchases
For international payments, refund posting times may also depend on the issuing bank, international card networks, currency conversion procedures, and financial processes in the customer's country.
Once the refund has been successfully processed through the corresponding payment system, Santo Games may assist by providing any available refund confirmation or documentation so that the customer can make the necessary inquiries with their bank or financial institution.
5. 🌎 INTERNATIONAL ORDERS
5.1. General Conditions
International shipments are subject to logistical availability, customs procedures, and the laws and regulations of the destination country.
5.2. Transit Times
Transit times provided by shipping carriers are estimates and may vary due to customs procedures, inspections, logistical disruptions, or other circumstances beyond the control of Santo Games.
5.3. Import Taxes and Charges
Any taxes, customs duties, import fees, or other charges imposed by the authorities of the destination country shall be the responsibility of the customer whenever applicable under local regulations.
5.4. Refused or Undeliverable Shipments
If a shipment is refused, abandoned, or returned because the recipient failed to complete required customs procedures or pay applicable customs charges, any potential refund will be evaluated considering the condition of the returned products, costs actually incurred, and applicable law.
6. 💳 PAYMENTS & FRAUD PREVENTION
Santo Games SpA may use fraud prevention and transaction verification systems provided by payment processors.
When there are reasonable grounds requiring verification, Santo Games may request additional information necessary to validate the transaction or may cancel and refund the transaction where appropriate.
Final stock availability is subject to successful payment confirmation.
7. 🛒 AVAILABILITY & STOCK
Product availability displayed on our website may vary due to simultaneous sales through different sales channels, inventory discrepancies, supplier allocation reductions, or other exceptional circumstances.
If Santo Games is unable to supply a purchased product, the customer will be informed and an appropriate solution will be provided. This may include a replacement expressly accepted by the customer, partial fulfillment with a refund of the difference, or a refund.
8. ⚠️ COMMERCIAL-QUANTITY PURCHASES
Santo Games primarily serves end consumers and collectors.
The store may establish purchase limits per customer when communicated in advance, particularly for high-demand or limited-availability products.
Transactions showing reasonable indications of fraud, abusive use of multiple accounts, or manipulation of purchasing systems may be reviewed and, where appropriate, cancelled.
9. 🚫 PAYMENT DISPUTES & CHARGEBACKS
Before initiating a bank or card dispute regarding a recognized transaction, customers are encouraged to contact Santo Games so that we can review the status of the purchase, shipment, or refund.
If a dispute or chargeback is initiated, Santo Games SpA may provide the payment processor or financial institution with legitimately available information relating to the transaction, including:
- Order and payment confirmation.
- Communications relating to the order.
- Shipping documentation.
- Tracking information.
- Delivery confirmation.
- Refund documentation.
- Acceptance of the applicable Terms & Conditions.
Santo Games reserves the right to restrict future transactions when there is objective evidence of fraud or abuse, without prejudice to any rights granted to consumers under applicable law.
10. ⚖️ LIABILITY & FORCE MAJEURE
Santo Games SpA shall not be liable for delays directly attributable to force majeure events or external circumstances beyond its reasonable control, without prejudice to any obligations and rights established under applicable law.
Delays caused by carriers, customs procedures, government authorities, manufacturers, or distributors will be handled according to the specific circumstances of each order.
11. 📧 COMMUNICATIONS
Communications regarding orders may be sent using the contact information provided by the customer at the time of purchase.
It is the customer's responsibility to provide accurate and up-to-date contact and shipping information.
12. ⚖️ APPLICABLE LAW
Purchases made from Santo Games SpA shall be governed by applicable Chilean law, including Law No. 19,496 on Consumer Protection, together with any other applicable regulations.
Nothing contained in these Terms & Conditions is intended to exclude or limit any consumer rights that cannot legally be waived under applicable law.
13. 🛍️ ACCEPTANCE OF TERMS
By completing a purchase, the customer acknowledges having had access to these Terms & Conditions and agrees to the conditions applicable to their transaction.
Acceptance of these Terms & Conditions does not constitute a waiver of any rights granted to the consumer under applicable law.
